As you all may have heard, Obama made a speech to kids this week. Now, I haven't checked with my niece and nephew to see if they've been turned into glassy-eyed drones with arms reaching out to mother government in hopes of a suck at her pork-laden teat, which I understand from respected commenters on the right is the likely response.

I am glad to see that one state-I don't need to tell you that it's Texas- is making sure that kids not only aren't exposed to Obama's evil and free of charge message of "work hard and stay in school," but has taken the affirmative step of bussing the kids, using my money taken from me at gunpoint by people with guns, to see George W. Bush speak.

I'm not sure if anyone here is a fan of George R. R. Martin's Song of Ice and Fire, but HBO is filming a pilot for an adaptation of the series. Cast as Ned Stark? Sean Bean.

Sounds pretty awesome. Here's hoping they pick it up.

1. Frank Ricci, plaintiff in Ricci v. New Haven, will testify at Sotomayor's confirmation hearing. I'm sure his learned opinions on stare decisis and the traditions of judicial interpretations of settled law will be enlightening. Or maybe he'll talk about how nobody empathized with him, whatever.

2. Does anyone know where you can buy senbei (toasted Japanese rice crackers)? My officemate here gave me some and now I really want more.

Made the mistake of reading about crazy stuff on the internet today.

Did you know:
1) some people have created their own "common law courts" where they sue real judges, cops, etc.? They apparently don't know what the common law actually is.
2) people think you can put a lien on your own property to ward off foreclosures?
3) someone must have spent days writing up this 50+ page website of craziness? Including such gems as:

"Abatements have the force and effect of an indictment and/or an at-Law case or suit when used against current international/martial rule courts. When the defendant doesn't answer, and with Default properly written and served, the case becomes Res Judicata, i.e., final judgment has been made."

"Abatement is the proper response to a court or agency by any godly Woman under Coverture; i.e., when under the covering of her husband, father, brother in Christ, or the Christ's assembly, in accordance with Scripture.
The first abatement served in this case abates the process improperly brought against a godly Woman under covering. Such an abatement is always issued by the bondman of Christ sitting as the woman's covering, for purposes of Law."

The Supreme Court issues its decision in Ricci v. DeStefano today. For those not up on such things, this was the New Haven firefighter case where the city threw out the results of a written promotion test after minority test-takers did disproportionately worse. The Supreme Court found it a violation of the Civil Rights Act to do so.

First, I should hope that when one of the hard-right conservatives says things like:
"Petitioners are firefighters who seek only a fair chance to move up the ranks in their chosen profession. In order to qualify for promotion, they made personal sacrifices.Petitioner Frank Ricci, who is dyslexic, found it necessary to “hir[e] someone, at considerable expense, to read ontoaudiotape the content of the books and study materials.”"

"Petitioner Benjamin Vargas, who is Hispanic, had to “giveup a part-time job,” and his wife had to “take leave from her own job in order to take care of their three youngchildren while Vargas studied.” Id., at 176a. “Vargasdevoted countless hours to study . . . , missed two of hischildren’s birthdays and over two weeks of vacation time,”and “incurred significant financial expense” during the three-month study period."


We can finally put to rest the conservative hysteria over Obama looking for empathy in a Supreme Court justice.

Second, not that I think it will, but this should put to rest any questions about Sotomayor's "decision" in this case on appeal. All 9 justices agree that this is an entirely new standard. I thought we wanted judges who applied the law, rather than making it themselves.

Third, it's nice of the Supreme Court to tell us that non-blatant discrimination is no longer a problem in this country.

Anyone else kind of think Mark Sanford killed Farrah Fawcett, saw that he was still on the front page of every news site, and then went after Michael Jackson?

It would almost be plausible if Sanford hadn't clearly given up on his career.

I came back to the office last night after the Yankee game to pick up my briefcase. There's a ton of film equipment set up outside (not unusual, since we are right near Battery Park and the US Custom House, both of which are often used in movies). I asked the guy what they were filming:

It's a live-action version, starring Nicholas Cage, of The Sorceror's Apprentice. Directed by Jon Turtletaub (of National Treasure).

There's not one thing there that doesn't suck.

So, have you ever suddenly remembered something that happened years ago and were suddenly enraged?

Longtime readers will recall that when [info]everfound and I were buying our current house, we had a mortgage all lined up and then, POOF, it went away. The reason given (on the 4th of July, no less): I wasn't technically employed yet, and [info]everfound was on disability. When we mentioned that she was on disability for pregnancy, we were told that "she's a credit risk because she might decide not to return to work after the baby."

I remember being on my way home from BarBri and literally screaming into the phone at the mortgage guy. I knew this couldn't be legal, but when I got home, my brain was so fried (recall also that our baby was born on July 7, so I was working with bar studying and impending baby) that I just couldn't find it. Then, we got our mortgage from the miracle of subprime mortgages (incurring a higher interest rate, of course), had the baby, moved, and I haven't really thought about it since then.

Until today, when it somehow blazed into my mind. Of course, now the HUD website is painfully easy to find. We could have filed a complaint and the HUD would have taken care of everything. Sigh. Commerce probably would have settled almost immediately, too, since this is a pretty clear case of illegal discrimination.

Grr. Somebody tell me that it doesn't matter. Or not; I won't even delete comments that disagree with me, like some losers I know. I'm just seeking catharsis by typing this anyway.

Congresslady Michele Bachman (R-MN), in her continuing quest to make Sarah Palin sound intelligent and articulate, had this to say on Tuesday:

I find it interesting that it was back in the 1970s that the swine flu broke out then under Democrat President Jimmy Carter. And I’m not blaming this on President Obama, I just think it is an interesting coincidence.

On my way to the train station this morning I was behind a car with 2 puzzling bumper stickers.

The first was "all hope is gone.". There was no indication of why all hope was gone, nor was there a link to an explanatory site (presumably so you didn't get your hopes up that it would make sense).

The second one was "NY Giants 2007 NFC Champions!" Lets ignore for a sec the cognitive dissonance between the 2 (after all, he could have bought the first sticker after Plax shot himself). As I recall, the Giants won the Super Bowl 2 weeks after winning the NFC championship. What kind if fan is rabid enough to put up a bumper sticker within 2 weeks of the game but pessimistic enough to not even give them a chance to win the actual superbowl? I mean it's not like we're talking about the Eagles.

You've probably read about "sexting." For some reason, idiot prosecutors seem to think that the appropriate punishment for such things is totally (and permanently) ruining kids' lives by charging them as child pornographers and forcing them to register as sex offenders. Anyway, some Pennsylvania kids sought (and got) a federal judge to issue a restraining order preventing the prosecutor from filing child porn charges. Thank god somebody stopped the idiot power-mad DA from bringing the criminal justice system into something that should really be dealt with by the parents.

The best(in a manner of speaking) quote:
"My big fear is setting the precedent that would allow criminals in the state system seeking protecting in the federal system." Skumanick [the DA] said.

Now, leaving out the fact that Skumanick apparently doesn't know English, one of (and IMHO, the most important) jobs of the federal courts is protecting people from having their Constitutional rights trampled by the states. Besides that, it's a huge step from 14 year old kids being protected from clearly ludicrous charges to a murderer getting a TRO against being prosecuted.

At least there are some nice things about being in the northeast...
